Session 3: From Dispute Boards to Arbitral Tribunal: leveraging multi-tiered dispute resolution mechanisms efficiently
Multi-tiered dispute resolution mechanisms are set up to, amongst others, manage and de-escalate disputes between contracting parties in business relationships. Often, such mechanisms are abused as guerilla tactics by recalcitrant parties or put in practice inefficiently – doing more harm than good. This panel will explore the practical impacts of having multi-tiered dispute resolution mechanisms involving Dispute Boards and arbitration, and provide insights into the working of decisions by Dispute Boards and how they may be relevant (if at all) in arbitration proceedings commenced thereafter.
