Speakers will debate whether institutions and arbitral tribunals should do more to involve in-house lawyers during arbitrations, such as including them in all case correspondence. Additionally, the panel will explore how arbitral tribunals can assist parties in achieving their own resolution by creating settlement and mediation windows during the proceedings.


Panel II - Key Issues in International Arbitration: Enforcement Challenges

When should a party decide not to pursue a claim due to uncertainty about the enforceability of an award? Are there steps that can be taken to enhance the likelihood of enforcement once dispute has arisen? This panel will delve into the challenges of enforcing arbitration awards in an increasingly complex global landscape, particularly in unstable jurisdictions and in the context of sanctions. Panelists will discuss strategies and key considerations when legal and political frameworks pose a threat to a party's ability to enforce an arbitration award.

This debate will explore how international arbitration is already evolving, and should continue to evolve, as a result of contemporary challenges and opportunities such as artificial intelligence and sustainability requirements.
