On the occasion of the Frankfurt Investment Moot, we invite you to join us for this ICC YAAF comparative panel discussion regarding recent jurisprudence of State courts concerning State immunity defense of sovereign States.
Enforcement against sovereign States becomes increasingly relevant and difficult. The number of sovereign States refusing to comply with final and binding awards voluntarily increases. The result is an ever-more complex and, in some cases, contradictory jurisprudence by State courts on topics of State immunity. Issues such as “Does the ICSID Convention constitute a general waiver of sovereign immunity?” or “Can investors enforce in assets of State-owned companies?” have occupied courts in many jurisdictions. The event will involve a panel of young practitioners from multiple jurisdictions (incl. Australia, England, France, U.S.), discussing the recent developments from their respective jurisdiction. The participants will be able to draw a meaningful comparison between the discussed jurisdictions, participate in the discussion and also share experiences from their own jurisdictions.
