This breakfast roundtable will take place on the occasion of the 7th Brazilian Arbitration Forum in Paris, on 13 September 2024.
While it is commonly accepted the arbitrators have the power to issue interim measures, the theory behind them is less obvious: How and when to requests interim measures? Why can interim measures be decisive for the outcome of the dispute? And what is the status vis-à-vis interim measures rendered by state courts? Is the Brazilian law and practice in this respect more developped that the one in France or Portugal? The panel will address these and more questions regarding the use (or abuse) of interim measures in international arbitration.
