Further to the unveiling of the ICC-Jus Connect-McCann Report on Cross-Cultural Business earlier this year, the session will set out the findings of the global survey and offer insights for North American businesses and dispute resolution professionals on new ways to look at commerce, culture, and dispute resolution.

As one of the most innovative and regulated sectors globally, the life sciences sector grapples with many sources of complex disputes, from intellectual property rights and licensing agreements to supply chain disruptions and regulatory compliance issues.  
 

This panel will explore the unique challenges and opportunities associated with resolving disputes through arbitration and ADR in the life sciences sector. Panelists will share their insights, experiences, and best practices for contracting in the life sciences sector and effectively navigating disputes that do arise. Finally, panelists will discuss the types of future disputes that will likely arise out of today's R&D, licensing agreements, and transactions.

Time to Retool: Unleashing the Potential of Under-Utilized ADR Tools and Techniques  
 

The use of ADR mechanisms other than arbitration can lead to more time- and cost-effective resolution of disputes, but mechanisms such as mediation, expert proceedings, and dispute boards are often overlooked and under-utilized. This interactive panel will focus on ways that parties, counsel, and arbitrators can effectively integrate these existing ADR tools and techniques, and adopt new creative approaches in their dispute resolution processes.  
 

This panel will start with a brief overview of the recent Effective Conflict Management report from the ICC Commission on Arbitration and ADR. Each panelist will then put forth an innovative proposal with respect to one ADR tool or technique that should be used more often to help parties get back to doing business.  The audience and the rest of the panel will be invited to engage in a dialogue with the panelists’ ideas and vote on their proposals.

Contracting and Arbitrating with States and State-owned Entities: Emerging Trends, Challenges and Best Practices  
 

States and state-owned entities (SoEs) are increasingly involved in cross-border commercial activity. The number of commercial arbitrations between private parties and state actors has grown significantly in the last decade, especially in the energy and infrastructure sectors, and is likely to continue rising as global economic dynamics shift.  

 

Commercial arbitrations with states and SoEs present unique challenges compared to disputes with only private parties. Panelists will shed light on best practices related to managing commercial arbitration proceedings with states and SoEs from initiation to award enforcement. They will also explore the latest on navigating sovereign immunity and delve into other critical substantive and procedural issues for effectively managing contracts and resolving disputes involving states and SoEs.

Cancellation policy

50% of the registration fee will be refunded if notice of cancellation is received in writing before Friday 23 August 2024. Cancellations after this date are non-refundable.

Please be informed that any form of cancellation will incur a cancellation fee of 20% of the registration fee which must be covered by the participant.

Subject to agreement from ICC Global Events prior to the event, the registration may be transferred to another person from the same company or organisation at no extra charge. Updated registration information will be required.
