The competing aims of confidentiality and transparency in arbitrations often strike at the inner workings of the arbitral process. While some argue that transparency is critical for development of arbitral jurisprudence, this impinges upon the inherent feature of any private dispute resolution process aimed at keeping high stakes disputes indeed ‘private’. The panel will dive deep into the intricacies of the conflicting themes of confidentiality and transparency, examine real-world examples and potential solutions. The panel will also discuss the critical issues including whether secrecy in arbitrations creates a lack of public accountability when public assets come into play.
