Session 1 – What comes before an egg? – A Prelude to Arbitral Procedures

Equally important (or arguably more important) than the arbitration proceeding itself is how parties and legal counsel may prevent disputes and manage pre-arbitral procedures. In this session, the panel will examine the crucial aspects of dispute prevention and pre-arbitral strategies. They will share their views on common issues and pitfalls that parties often have to address while endeavouring to keep time and costs efficient.

Session 2 – Welcoming change of tides: New developments in arbitration law and practice in Indonesia 

At the end of 2023, the Supreme Court of Indonesia published a new Supreme Court Regulation No. 3 of 2023 on Procedure for the Appointment of Arbitrators by the Court, Challenge Rights, Examination of Enforcement Applications, and Arbitral Award Annulment (“SC Regulation”). The SC Regulation is viewed as a positive development of arbitration practice in Indonesia as it provides more clarity and guidance on some contentious aspects within the Indonesia’s Arbitration Law No. 30 of 1999 such as the definition of public policy, a procedural timeline on enforcement and setting aside of arbitral awards before Indonesian courts, and asset seizure. This panel will discuss these changes and their implementation in arbitration involving Indonesia.

Session 3 – Tic-Tech-Toe: how to best leverage technology in dispute resolution 

In today’s world, technology has undoubtedly been entrenched in our day-to-day work and dispute resolution has come to depend on technology, especially post-pandemic. In 2022, the ICC Commission on Arbitration & ADR released its Report on Leveraging Technology for Fair, Effective, and Efficient International Arbitration Proceedings (“Commission Report”). Discussing Commission Report and practical experiences, the panel will consider new technologies in dispute resolution and highlight best practices.

Session 4 – Behind Closed Doors: The ICC Court in action - scrutinising draft arbitral awards

One of the hallmarks of ICC arbitration is the scrutiny of draft awards undertaken by the ICC Secretariat and members of the ICC International Court of Arbitration (“ICC Court”). Members of the ICC Court will lead an interactive mock plenary session, and conference attendees will be able to act as Court members, contributing to the scrutiny of a mock draft award. This session will highlight how the ICC Court may approach various issues in draft awards and how this service improves the quality and enforceability of each ICC award.
