Following the success of past editions, the annual ICC Malaysia Arbitration Day returns to Kuala Lumpur for its fourth edition. Join us for this Conference where thought leadership and “glocal” professional networks coalesce!

This year’s Conference features panel discussions representing trajectories for arbitration – present and future – through select topics of key developments from the region and how they might transpire in practice for disputes with Malaysian nexus. The Conference also offers opportunities for private practitioners, experts, and professionals alike to (re-) connect with peers and colleagues in the dispute resolution industry.

This debate session will examine whether international arbitration is uniquely vulnerable to such tactics, whether tribunals should take a firmer approach to procedural misconduct, and where the boundary lies between legitimate advocacy and abuse of process.

The debate will explore three themes:

(2) Are tribunals sufficiently equipped to respond?

(3) Where should the balance lie between efficiency and due process?
