Virtual Hearings: Practice and Reflection

Since the beginning of 2020, the outbreak and vast spread of COVID-19 has undoubtedly become the greatest challenge facing the entire world. Various industries across the globe have been using information technologies for months to ensure a robust resumption of business while continuing to prevent COVID-19 from further spreading. This epidemic has also led to a large-scale “online experiment” in the field of arbitration. Many arbitral institutions, both domestic and abroad, have introduced measures or guidelines for online hearings to ensure that arbitration cases are on track and practical difficulties caused by the epidemic are minimized.

However, as an innovative measure, virtual hearing is faced with challenges as well. For example, the potential risks of video conferencing, including the insurance of due process, justice and fairness, security and privacy issues, and hardship and difficulties caused by technical errors. In addition to that, further consideration is also needed in issues such as the supervision of parties in different regions, the guarantee of the integrity and independency of witnesses, and inspection and protection of original evidence.
