Term of Use
Article 1 – Scope of Application
Use of the Site (hereinafter the “Service”) is understood as access to the Site or use of the information and documents (text, images, sound) displayed on the Site as well as use of the features of the Site, including but not limited to the creation of a personal account.
Access to the Service by a User implies that the User accepts and complies with all the stipulations of the present terms. In the event that a User does not wish to accept all or part of the present Terms, he or she is requested to discontinue all use of the Service.
Article 2 – Registration on the Site
2.1 Collection of Personal Information
During creation of a personal account on the Site, the User is invited to provide personal information. This information allows ICC Services to perform the Service. The information necessary for ICC Services to perform the Service is indicated with an asterisk on the pages of the Site.
The other information requested, to which response is optional, is intended for better understanding of users and improving the Service as a result.
2.2 Communication by Email
The data collected will allow ICC Services to send You communications connected with use of the Service, which may include but are not limited to:
- Registration on the Site. New members will receive a welcome email reminding them of their username and password enabling access to their account;
- Request to close the account. In the event of closure of an account, an email notifying closure of the account will be sent to the customer;
- Request for help or submission of questions/suggestions. ICC Services will respond by email to a user requesting help;
- Purchases. When Users place an order online, several follow-up emails are sent to them as the transaction progresses.
2.3 Email Mailing List
The creation of a personal account on the Site automatically causes the User to be included on the news distribution list for the Site (otherwise known as the Newsletter).
Users can cancel this subscription by clicking on the unsubscribe link displayed at the bottom of each email or by managing their subscription from their account on the Site.
Article 3 – Processing of Personal Data
ICC Services places great importance on the confidentiality of personal data. For more information on the management of your data and your rights, we invite you to consult the Data Protection firstname.lastname@example.org.
Article 4 – User Generated Content
4.1 Ownership of Content
When a User posts opinions, notes, ideas, remarks, questions or any other data (text, image, sound) (hereinafter “User Generated Content”) on the Site or by means of the Site, this content becomes the exclusive property of ICC Services. User Generated Content is deemed non-confidential and can be used or disclosed in any manner whatsoever, without obligation or prior notice.
User Generated Content is deemed to be the work of the User submitting it and must not therefore be copied in full or in part from a third party.
ICC Services is under no obligation to review User Generated Content, is in no way responsible for this Content, and does not guarantee its accuracy, integrity or quality and cannot guarantee that no harmful, inaccurate, misleading, offensive, threatening, defamatory, unlawful or indeed objectionable Content will appear on the Site. ICC Services is therefore only acting as a simple intermediary for passive distribution and is not liable for any obligation in connection with the said Content or any responsibility for the activities of Users on the Site.
4.2 Control of Content and Moderation
Without prejudice to the foregoing, ICC Services reserves the right to control User Generated Content published on the Site. In addition, ICC Services reserves the right to modify, update, or refuse publication or delete this Content, in full or in part, for any reason (or no reason) and to disclose this same Content as well as the circumstances surrounding its transmission to a third-party. ICC Services is under no obligation to use or respond to User Generated Content.
4.3 Prohibited Content
User Generated Content must not be offensive, obscene, defamatory, unlawful or liable to contravene the laws in force, whether arising under civil, criminal or any other form of law.
Article 5 – Cookies
Use of the Service can lead to placement of cookies on your computer. They simplify your visit and improve the usability of the Site during your navigation. When You use the Service, your personal identifiers are referenced to the cookie with the aim of improving the Service. This information is encrypted and is not accessible in the event of unauthorised access to your computer.
Article 6 - Links to Other Sites
The Site may offer hypertext links to external Internet sites. ICC Services cannot be held responsible for the use or content of Internet sites to which it has provided links.
Article 7 - Intellectual Property
The Site, its content and all the elements comprising it, are creative works over which the ICC and ICC Services and/or, as applicable, its partners, hold all the intellectual property rights and/or exploitation rights, including in particular the copyright, database, trademark, and design rights. The Site, including the software, databases, text, information, analyses, images, photographs, graphic design, logos, sounds and any other data contained on the Site, remains the exclusive property of the ICC and ICC Services and/or its Partners or, as applicable, of their respective owners with whom they have entered into licence agreements. You are granted a non-exclusive, non-transferable and private user right for the Site. The right thereby granted consists in a right to consult the data and information contained on the Site online. This right of use applies only to use for strictly personal purposes. Any full or partial reproduction of the ICC Services catalogue is strictly prohibited. Any other use of the Site, and in particular commercial use, by You is prohibited. You agree, in particular and without the following being exhaustive, not to reproduce and/or represent except privately, sell, distribute, issue, translate, adapt, broadcast or communicate in full or partially in any manner whatsoever any element, information or data of the Site. In addition, you agree not to enter, by any means whatsoever, data liable to modify or harm the content or presentation of the Site.
