ICC Young Arbitrators Forum (ICC YAF) is back in Zurich with an in-person event to spark a lively debate on the use of fact witnesses in arbitration.

In arbitration proceedings, fact witness testimony is often an essential form of evidence. Parties usually provide written witness statements in the context of their written submissions. The witnesses are then subjected to direct and cross-examination, as well as questions from the arbitral tribunal, during the evidentiary hearing.

During this conference, panellists from different backgrounds will share their experience dealing with fact witnesses in arbitration proceedings.

  • A first panel will address the pre-hearing phase and discuss, among other topics, how to select your witnesses, how to draft written statements and how to address any duties of confidentiality and loyalty to which a witness may be subject.
  • A second panel will address three essential topics at the hearing phase: how do you best prepare your witnesses for the hearing, how do you examine a witness, and what obstacles may arise during the examination?

Join us to share your own experiences, learn about best practices and receive practical tips. This conference is aimed at young arbitration practitioners – external counsel, experts, in-house counsel, academics and budding arbitrators – of approximately 40 years of age or under (although anyone interested in the topic is welcome to attend).
