ICC YAF: ICC Case Administration

For students and young lawyers who would like to get involved in the arbitration practice, it is important to acquire knowledge about the basic, but most important aspects of arbitration. The first and foremost subject is drafting an effective and valid arbitration clause this being the prerequisite condition that leads us to the world of arbitration.

On this first day of the certificate program on the ICC Arbitration Rules, we will focus on the drafting of a valid arbitration clause.

In the first session, we will present Articles 1 to 3 of the ICC Arbitration Rules; go through the definitions in the Rules and the ICC case administration steps (written notifications or communications, timeline, etc.)

In the second session, we will discuss in detail the issues that should be taken into consideration in order to draft a valid arbitration clause from both in-house and local counsel’s perspectives. These discussions will touch upon the legal requirements as well as problems encountered in practice to avoid pathological clauses.
