ICC YAF: Experts versus Expertise

A ‘battle of experts’ is a frequent phenomenon in international arbitration. But what is the added evidentiary value of external party-appointed experts where the expertise is equally or better available in-house, or where such experts are not strictly necessary? Are external experts only cost-drivers or are they nevertheless useful and, if so, why?

A panel consisting of an arbitrator, an external expert, an in-house counsel and two counsel will explore the added value of expert evidence where the relevant expertise is also available within the parties' organisation, including their legal counsel. We aim to spark a lively debate by addressing this topic from different stakeholder and jurisdictional viewpoints. Central questions will revolve around the power play between the parties, the subject matter of the dispute and the independence and impartiality of experts.

The event is aimed at all lawyers specialising in dispute resolution, in-house counsel with a litigation background, (upcoming) arbitrators, and experts involved in arbitration.
