Trends on Increasing Efficiency and Transparency in Arbitration: the example of the 2021 ICC Rules of Arbitration

This ICC YAF event is a satellite event of Saint Petersburg International Legal Forum.

As a part of the Online Saint-Petersburg Legal Forum, we will discuss major transparency and efficiency related challenges faced by the parties in arbitration and provide the legal community with extended information about the way the ICC International Court of Arbitration deals with these issues in its new 2021 Rules of Arbitration which are widely viewed as a further step towards greater efficiency, flexibility and transparency.

The participants will be divided into breakout rooms where the speakers will share experiences and explain the following topics:

  • Optimising the use of technology: we will discuss amendments on paperless filings and remote hearings, as well as other practical tips on the increased use of technology in arbitration
  • Complex arbitrations: we will discuss changes as to consolidation and joinder as well as new provisions aiming to increase efficient management of complex arbitrations
  • Increasing transparency: The growing demand for transparency in international arbitration has resulted in an increased scrutiny into disclosure obligations. We will notably discuss new rules on disclosure of third-party funding as well as conflict of interests.
