ICC YAF: Don’t forget! How many details can a fact witness remember?

Join us for a discussion on the impact of witness evidence on arbitral tribunals’ decisions at the occasion of the Cross Examination Moot.

There are several reasons why the memory of fact witnesses deserves greater consideration by the arbitral community. Among these reasons are, in particular, the time and costs invested in the preparation of witnesses and the impact that witness evidence can have on the final decisions of arbitral tribunals. 

Based on the ICC Commission report "The Accuracy of Fact Witness Memory in International Arbitration", the panel will discuss the witnesses’ memory and offer recommendations to reduce the memory-distorting influences and their impact on witness statements. Recommendations will focus on conducting examinations, assessing the information offered by witnesses, and preparing witnesses prior to a hearing.

Who should attend?

This conference is aimed at young arbitration practitioners of approximately 40 years or under: counsel, arbitrators, corporate counsel or academics. The ICC YAF Conference is an ideal forum for young practitioners to exchange thoughts on international arbitration and to enrich their network in the region.
