Join us for the final edition of our ICC YAF series “Traveling through Latin America”, where we will discuss corruption in arbitration and how it has evolved in Latin America.  

ICC YAF wants to take you on a journey traveling through Latin America, where in each edition we will focus on different topics relevant to the region. In this final edition of our six-part series, we will transport you to Brazil and Peru.

This conference is aimed at young arbitration practitioners of approximately 40 years or under: counsel, arbitrators, corporate counsel, or academics. Corruption in Arbitration: How has this issue evolved in Latin America

(i) Do arbitrators have a duty to inform the relevant authorities when faced with corruption issues in the arbitral proceedings?

(ii) Should evidence produced and decisions rendered in parallel proceedings (ex., criminal proceedings) regarding the same corruption issues at stake in the arbitration have any bearing on the arbitrators' decision?

(iii) Does the difficulty to prove corruption justify a special burden and standard of evidence?

(iv) What are the consequences in an arbitration if the contract was procured/awarded due to bribes?
