We will discuss arbitrator transparency in investment arbitration from three different angles: information available about arbitrators’ past decisions (and, potentially, future decision-making), information available to institutions, and information available about ongoing procedures.
This event will be held in connection with the Frankfurt Investment Arbitration Moot Court and hosted by DLA Piper. In this year’s edition the discussion will revolve around arbitrator transparency in investment arbitration. Attendants will hear and discuss which information is available to the public that may help parties to make the right choices at the beginning of an arbitration proceeding, particularly with regard to arbitrators’ future decision-making. Institutions know more about their arbitrators than the parties to an arbitration proceeding or the general public. What can institutions do to safeguard the right level of transparency in investment arbitration? Ultimately it will be the arbitrators who may or may not disclose information on arbitration proceedings. Should arbitrators be more open about their decision-making process in investment arbitration? How can arbitrators achieve the right level of transparency? We look forward to a vivid discussion.
