ICC YAF: Arbitration and State Entities

ICC Young Arbitrators Forum (ICC YAF) is organizing a conference on the challenges, special procedures and external pressures that state entities confront when agreeing to commercial arbitration to resolve contract disputes.

This ICC YAF Conference will be held in Spanish.

The main objective of this conference is to discuss if rules of arbitral institutions and national arbitration laws should include provisions and special procedures to address the particularities of arbitrations involving state entities.

The following topics will be addressed during the conference:

  • Special procedures that state entities must complete prior to the execution of an arbitration agreement and appointment of arbitrators.
  • Procedural opportunities for third parties to intervene in arbitrations involving state entities (e.g., public stakeholders, state agencies, etc.).
  • The necessity and viability of applying public international law in arbitrations involving state entities.
  • Emerging tensions between transparency, publicity and confidentiality in arbitrations involving state entities.
  • Is third-party funding a legally viable alternative for financing state entities’ claims in arbitration?

This ICC YAF Conference is being organized at the occasion of the ICC+ ITA + ALArb Conference that will take place on 3 September in Medellin.

Who Should attend?

Practicing lawyers, corporate counsels, in-house counsels, arbitrators and other dispute resolution services practitioners, academics and professionals involved and/or interested in obtaining further knowledge and keep up to date with domestic and international arbitration in the Latin America.
