Join us to discuss the current and future evolution of the role of the arbitral tribunal in facilitating settlement of parties’ disputes.
While arbitrators in some jurisdictions are accustomed to proactively encouraging settlement throughout arbitration proceedings, arbitrators, counsel, and parties in other jurisdictions see the role of the arbitral tribunal as only deciding upon an enforceable award.
Panelists will engage in a roundtable discussion examining the present and future role of how the arbitrator, in addition to other ADR tools, can be utilized to facilitate settlement. The panelists will also consider the merits of specific approaches to integrating settlement into arbitration proceedings, some of which are addressed in the ICC Commission’s recent Report on Facilitating Settlement in International Arbitration. The audience will be invited to vote upon the different approaches discussed by the panelists.
Open to those aged 40 and under, YAAF provides opportunities for individuals to gain knowledge, develop their skills and understand ICC’s arbitral procedure and other dispute resolution services.
