Shedding light on the global best practices in dispute prevention and resolution Selection of the most appropriate ADR technique prevents escalation, saves costs, and stops avoidable disputes. For the pre-dispute phase, this goal is achieved through ‘Effective Conflict Management’ and post-dispute stage by ‘Facilitating Settlement in Arbitrations’. The panel will share effective means of conflict management for companies, legal representatives, and adjudication bodies, followed by a discussion on effective dispute resolution mechanisms like the med-arb combinations. Resolving shareholder and joint venture disputes while protecting the business Mumbai is the economic powerhouse for the business and financial industry in India with scores of agreements being closed in each financial quarter. While disputes arising out of shareholder agreements and joint venture agreements make up a significant practice area for practitioners within and outside India, a common pitfall is the erosion of the business interest during the prolongation of the dispute. The panel will begin by examining the key concerns and common sources of disputes arising out of joint venture and shareholder agreements and shed light on the legal position on these issues while discussing the landmark decisions. The session will highlight techniques and lessons learned from past cases on the substantive and damages fronts for effectively utilising the discovery phase of the dispute to obtain evidence and tips on building a solid case.
