The Tale of Building Trust: Arbitration and ADR as the go-to dispute settlement mechanism for pharmaceutical and biotechnology disputes Following the COVID-19 pandemic, the international arbitration community has witnessed an increase in pharmacology and biotechnology disputes. These industries can be tricky to navigate due to their complex workings of supply, production, manufacturing, licensing, and distribution chains. As a result, disputes concerning intellectual property rights and breaches of distribution agreements, amongst others, often arise. This panel will discuss how arbitration and/or other ADR mechanisms may benefit parties in different types of pharmacology and biotechnology disputes and how these methods may, in practice, complement litigation alike.

Corruption in International Arbitration With several multilateral trade and investment agreements in the Asia Pacific region, coupled with an increasing appetite for business, more and more countries in the region are engaging with foreign companies. As encouraging and as thrilling as this sounds, issues of corruption and illegality cannot be laid to rest just yet. In this session, the panel will examine the lay of the land in terms of corruption in international arbitration. The panel will navigate how states and its entities may work together with the relevant stakeholders such as national corruption commissions, lawyers and business players in harmonising the combat of corruption and illegality in foreign investment and alternative dispute resolution mechanisms.

House A: This House believes that the ‘No Win No Fee’ scheme is a welcome feature in strengthening international ADR practice House B: This House believes that the ‘No Win No Fee’ scheme should not be legislated for use in international ADR practice In recent years, legislative changes pertaining to the ‘No Win No Fee’ scheme has emerged as a hot topic in international arbitration. In January 2022, Singapore passed a law that allows lawyers and their clients to enter into ‘no win no fee’ agreements in certain proceedings, including those of arbitration and mediation. Meanwhile, in Hong Kong, efforts to put ‘no win no fee’ into legislation for arbitration and related court proceedings are in motion. This panel will delve further into the topic and discuss the impact of this arrangement on arbitration practice and any potential repercussions along the way. Jury:

ICC Sanitary Protocol for Events The safety and wellbeing of participants in ICC events is a fundamental concern of the organisation. Registration and participation in an in-person ICC event requires that you adhere to health and safety measures implemented by the organisers and that you agree to comply with those measures at all times. Those measures may vary depending on local health and safety considerations including government regulations and guidelines, and rules governing the venue. Participants at ICC events accept the risk of change of health and safety obligations and its impact on measures implemented by organisers which may include: showing a valid health pass, social distancing, use of tracing devices, wearing masks, temperature measurement, use of hydro-alcoholic gel, limiting number of participants and restricting their physical gathering, holding the meeting virtually, limiting catering services. By registering and attending the 7th ICC Asia Pacific Conference in Singapore you undertake to comply with health and safety regulations imposed by the local authorities and the hotel. You also acknowledge that you are required to be fully vaccinated and that it is mandatory to wear a mask in all indoor areas of the hotel. This event is eligible for credits/hours/points before the French Bar, NY Bar, and Singapore Bar. The Conference has been provisionally awarded 6 Public CPD Points (TBC) by the Singapore Institute of Legal Education. For this purpose, please note that the level of this training is advanced and the practice area is Alternate Dispute Resolution. This is subject to validation of ICC Global Events’ applications (or individual application, as necessary) to the afore mentioned Bars. Further, ICC Global Events is a State Bar of California approved MCLE provider. Participants who wish to obtain CPD Points are reminded that they must comply strictly with the Attendance Policy set out in the CPD Guidelines. Cancellation Policy

50% of the registration fee will be refunded if notice of cancellation is received in writing before Friday 20 May 2022. Cancellations after this date are not refundable. Please be informed that any form of cancellation will incur a cancellation fee of US$7 + 2.75% of the registration fee which must be covered by the participant. Subject to agreement from ICC Global Events prior to the event, the registration may be transferred to another person from the same company or organisation at no extra charge. Updated registration information will be required. Please note that ICC reserves the right to cancel this event or to make minor alterations to the content and timing of the programme or to the identity of the speakers. In the unlikely event of cancellation, delegates will be offered a full refund. ICC will not, however, be held responsible for any related expense incurred by the participant. |
