An introduction to interest – from an economic perspective Interest in international arbitration is an important yet poorly understood topic. In this first session, participants will be introduced to the economic basis and rationale for awarding interest. Economic experts will outline the different types of interest and identify the relationship between interest rates and currency, exchange rates, and inflation. Throughout the session, speakers will illustrate concepts using examples.

Legal basis for awarding interest This session builds on the previous one. Once participants have understood the foundations of interest, it will be time to turn to the legal basis for awarding interest. In this session, participants will cover four topics, (i) legal authority for awarding interest, (ii) choice of rate of interest, (iii) period of interest – pre-and post-award interest, and (iv) simple v compound interest. In this session, speakers will adopt a comparatist approach to contrast approaches in different jurisdictions, and set out relevant considerations such as applicable law, mandatory v discretionary rules, and public policy considerations.

Behind the scenes: Mock ICC Court Session on Draft Award Scrutiny - IN ENGLISH ONLY Members of the ICC Court and Secretariat will lead an interactive mock plenary session and conference attendees will be able to act as Court members contributing to the scrutiny of a mock draft award. This session will highlight how the ICC Court may approach various issues in draft awards and how this service improves the quality and enforceability of each ICC award.
2. Decommissioning of oil & gas projects: risk mitigation and resolution of disputes As oil and gas assets reach the end of their lifecycles and the energy transition continues apace, a wave of decommissioning-related disputes seems inevitable.
