The annual ICC Indonesia Arbitration Day brings together leading professionals in the legal industry to discuss key issues concerning international arbitration with special attention placed upon Indonesian practice. This is the first in-person engagement at the event by the President of the ICC International Court of Arbitration, Claudia Salomon.
Objective/Who should attend?
We highly encourage Indonesian legal practitioners, In-House Counsel, and law students and academicians to attend the event.
We also welcome participation by peers and colleagues in the industry who are interested to learn more about ICC's footprints and work in relation to dispute resolution services for Indonesian parties, in particular, and parties coming from Asia-Pacific region, in general.

Session 1 – Charting the waters: the current state and trends of arbitration and alternative dispute resolution (ADR) in Indonesia As a global economy powerhouse, Indonesia remains steadfast in its industrial growth and is still one of the most preferred trade and investment hubs in Asia-Pacific region and beyond amid COVID-19 pandemic and evolving geopolitical climate. Many wonder how different industries in Indonesia deal with disputes that may arise in today’s business climate, and how they may manage business risks to avoid disputes in the future. In this Session, the Panel which consists of experts and professionals from Indonesia’s various leading industries will share their views and experience on the topic and discuss how business and legal communities in Indonesia today perceive arbitration and ADR, the importance of holistic dispute management that gains traction in the context of contract drafting and risks management.

Session 2 – Joining forces: business continuity and legal advocacy in merger & acquisitions (M&A) and debt restructuring While the world is recovering from the pandemic effect, many businesses realise the importance and merits of M&A and debt restructuring for business continuity. In recent years, Indonesia-based and Indonesian-linked companies have entered successful M&A and undertaken debt restructuring, across different jurisdictions. Moreover, matters regarding M&A and debt restructuring remains complex and time consuming. In this Session, the Panel will explore the present state and regulatory compliance of M&A and debt restructuring involving Indonesian businesses, as well as how arbitration and ADR may serve as the most suitable toolkit to support the M&A and debt restructuring efforts in the long run.

Session 3 – House of cards: enforcement of arbitral award in Indonesia Twenty-three years after the inception of Indonesian Law No 30 Year 1999 on Arbitration and Alternative Dispute Resolution, arbitration stakeholders in Indonesia and abroad still regularly encounter contentious issues regarding the enforcement of an arbitral award. From early stages of enforcement until the aftermath of un(successful) enforcement of an arbitral award, variety of issues often arise which include but are not limited to dilatory tactics, asset tracing and recovery, incapacity of a party, and validity of the original arbitration agreement. The panel will discuss topical sub-issues concerning enforcement of arbitral awards in Indonesia, how the manage them, and what parts of the relevant law and regulations in Indonesia can be improved to bolster international arbitration landscape in Indonesia.

Session 4 – Finding trusted partners: the importance of ancillary services providers in arbitration & ADR practice In any arbitration & ADR proceedings, clients and legal representatives often leave selection and management of ancillary services until the early submissions of the proceedings are completed. While this may not be a problem before the pandemic, continuing such practice these days may not be the best regardless of travel restrictions easing. Furthermore, ancillary service providers, in fact, hold the same importance as arbitral institutions and law firms that serve as clients’ trusted partners in ensuring efficient and streamlined process. In this session, the Panel that consists of arbitration & ADR services providers such as; document repository and hearing solutions providers, experts, and third party funders will impart their experience and knowledge about their line of work, why and how these services matter the most, and how clients, legal representatives, and arbitral institutions can best work together in the context of the arbitration & ADR ecosystem.
